Physical Assault Victims
Victims of sexual or physical assault, in addition to seeking prosecution against perpetrators, may also collect damages in civil suits. This is generally well known due to publicity regarding alleged or proven sexual assault cases against celebrity athletes--who often have the ability to pay for the damages they have caused.
However, there are times when, not only the perpetrator, but also third parties who permitted conditions to exist that resulted in a sexual or physical assault--may be held liable. Here are a few examples of such potential liability:
-
School officials fail to adequately supervise a sporting event, and a student is assaulted in the stadium parking lot.
-
A church or religious organization has knowledge that a member of their clergy is engaging in pedophilia, and ignores the situation. An altar boy is subsequently sexually assaulted.
-
An apartment building landlord does not provide adequate security, and a tenant is assaulted and raped in a stairwell.
Often such third parties have insurance to cover the damages that ensue from their lax supervision or management. At Rosenberg Kirby Cahill & Stankowicz, our attorneys have the experience and litigation skills to thwart insurance company efforts to minimize or dismiss liability.
Our lawyers have the resources to properly investigate such physical or sexual assault incidents over and beyond what law enforcement officials might do to establish the guilt of a criminal suspect. We also have the ability to analyze statistics and event history, in order to detect a pattern that would indicate that an assault or rape was a foreseeable result of inadequate supervision or management.
If you have been sexually or physically assaulted, please contact us at once so we can evaluate your case, and begin protecting your rights. All these matters will be treated with confidentiality. As in all of our personal injury cases, the initial consultation is free, and there is no fee unless we recover damages for you.
